TERMS AND CONDITIONS OF SALE

1. Scope and validity of the terms of sale

  • 1.1 The Terms and Conditions of Sale shall apply to all legal relations between any person (hereinafter referred to as the Buyer) and 365JP OÜ, the owner of 365jp.eu (hereinafter referred to as the 365JP e-shop), in relation to the purchase of products via the 365JP e-shop.
  • 1.2 In addition to these Terms and Conditions, legal relations arising from the purchase of products through the 365JP e-shop are governed by the Law of Obligations Act (hereinafter LOA), the Consumer Protection Act (hereinafter CCPA) and other legislation in force in the Republic of Estonia.
  • 1.3 365JP OÜ is entitled to amend and supplement these terms and conditions and the price list in the light of the development of the 365JP e-shop and in the interests of better and safer use of the e-shop. Changes and amendments to the terms and conditions and the price list will be communicated via the website www.365jp.eu. Amendments and supplements to the Terms and Conditions and the Price List will enter into force upon publication of the amendment or supplement on the website www.365jp.eu. If the Buyer has submitted his order before the entry into force of the amendments to the Terms and Conditions, the legal relationship between the Buyer and 365JP OÜ shall be governed by the terms and conditions in force at the time the Buyer submits his order, unless otherwise provided by law or these Terms and Conditions.

2. Price information

  • 2.1 The prices of the products sold in the 365JP e-shop are indicated with the products and all prices include VAT at 22%.
  • 2.2 For purchases, the price of transport according to the delivery method chosen by the Buyer (Omniva parcel terminal 3.60 euros, SmartPOST parcel terminal 2.60 euros, DPD parcel terminal 2.75 euros) is added to the price. The delivery charge will be displayed to the Buyer when placing the order.
  • 2.3 There is no minimum order price limit. For orders over 35 euros, delivery is free of charge for the Buyer.
  • 2.4 Prices are valid from the time of placing the order until the expiry of the payment term of the placed order (2 days after placing the order).

3. Placing an order

  • 3.1 In order to order a product, you must add the desired product to your shopping cart by clicking on the “Add to cart” link.
  • 3.2 To place an order, click on the “Pay now” link.
  • 3.3 On the order form, fill in the required fields and select the delivery method that suits you, read and accept the terms and conditions of sale and click on the “Place an order” link. An invoice will then appear on the screen, which you can pay conveniently by bank transfer or other payment method.
  • 3.4 Please fill in the required fields correctly when placing your order, as the accuracy and correctness of the information provided will determine the prompt and smooth delivery of the goods and the subsequent resolution of any disputes and claims. When you register a customer account, information about it will be sent to the e-mail address indicated in the data.
  • 3.5 The processing of orders placed in the e-shop is carried out on working days (Mon-Fri 9.00-17.00). If the order is placed later than 14.00 on a Friday, the order will be processed the following Monday.
  • 3.6 If the ordered goods cannot be delivered due to the expiry of the goods or for any other reason, the Buyer shall be notified thereof as soon as possible and the money paid (including the costs of delivery of the goods) shall be refunded without delay, but not later than 14 days after the notification.

4. Entry into force of the sales contract

  • 4.1 By the contract of sale of the Goods, 365JP e-shop undertakes to deliver to the Buyer the Goods existing, manufactured or to be acquired by 365JP e-shop in the future and to enable the transfer of ownership to the Buyer, while the Buyer undertakes to pay 365JP e-shop the amount indicated on the invoice for the Goods and to accept the Goods.
  • 4.2 Orders for which payment has not been received will be cancelled 2 days after the order has been placed.
  • 4.3 The contract for the sale of the Products shall be deemed to have been concluded (entry into force of the Contract) from the date of receipt of the amount due according to the order confirmation to the 365JP e-shop bank account.

5. Delivery to

  • 5.1 After the sales contract has entered into force, 365JP’s e-shop will complete the order and hand it over to the company’s logistics partners for delivery.
  • 5.2 The delivery deadlines indicated on the 365JP e-shop website are valid from the moment the order amount is credited to the 365JP e-shop bank account.
  • 5.3 In order to ensure prompt delivery, care must be taken to provide correct and valid details when completing the order form.
  • 5.4 365JP e-shop shall not be liable for any delay in the delivery of the goods if the goods have been delivered to the logistics partners on time, but the delay in delivery is due to circumstances that 365JP e-shop could not influence or foresee.

6. Right of withdrawal

  • 6.1 After receipt of the order, the Buyer has the right to withdraw from the contract concluded in the e-shop within 14 days (depending on the products, the Buyer may not have the right to withdraw, the relevant products and services must be listed in such a case and must meet the conditions listed in section 53(4) of the LOA).
  • 6.2 The right of withdrawal does not apply if the Buyer is a legal person.
  • 6.3 In order to exercise the 14-day right of return, the Buyer may not use the goods ordered in any other way than is necessary to ascertain the nature, characteristics and functioning of the goods in the way that is normally permitted in a shop for the purpose of testing the goods.
  • 6.4 If the Goods have been used for purposes other than those necessary to ascertain the nature, characteristics and functioning of the Goods, or if the Goods show signs of use or wear, 365JP e-shop has the right to reduce the refundable fee in accordance with the reduction in the value of the Goods.
  • 6.5 In order to return the Goods, you must submit a free-form declaration of withdrawal from the purchase of the Goods, which may be sent to info@365jp.eu no later than 14 days after receipt of the Goods.
  • 6.6 The Buyer shall bear the costs of returning the Goods, unless the reason for returning the Goods is due to the fact that the Goods to be returned do not correspond to what was ordered (e.g. the Goods are wrong or defective).
  • 6.7 The Buyer must return the Goods within 14 days of the submission of the application or provide proof that he has handed over the Goods to the logistics company within the aforementioned period.
  • 6.8 Upon receipt of the returned goods, the 365JP e-shop shall refund to the Buyer immediately, but not later than 14 days from the date of receipt of the notice of withdrawal, all fees received from the Buyer under the contract. 365JP e-shop may refuse to make refunds until it has received the goods covered by the contract or until the Buyer has provided proof that it has returned the goods, whichever is the earlier.
  • 6.9 If the Buyer has expressly chosen a delivery method other than the cheapest delivery method offered by 365JP e-shop, 365JP e-shop is not obliged to reimburse the Buyer for the cost that exceeds the cost associated with the usual delivery method.
  • 6.10 365JP e-shop has the right to withdraw from the sales transaction and to demand the return of the goods from the Buyer, if the price of the goods in the online shop is indicated significantly below the market price of the goods due to a mistake.

7. Unquantifiable force

  • 7.1 365JP e-shop shall not be liable for any damage caused to the Buyer or any delay in delivery of the goods if the damage or delay in delivery of the goods is due to circumstances which 365JP e-shop could not influence or foresee.

8. Processing of personal data

  • 8.1 The 365JP e-shop uses the personal data provided by the Buyer (including name, telephone number, address, e-mail address, bank details) only for processing the order and sending the goods to the Buyer. The 365JP e-shop transfers personal data to companies providing transport services in order to deliver goods.
  • 8.2 The Buyer has the right at any time to prohibit the collection and use of his/her personal data, unless this is necessary for the collection of a claim arising from the contract or for the delivery of the goods.
  • 8.3 The use of electronic personal data for direct mailing purposes will only take place if the Buyer has given his or her separate consent to this on the website www.365jp.eu .
  • 8.4 Encrypted data communication with banks when paying for purchases ensures the security of the Buyer’s personal banking details, which are not accessible in the 365JP e-shop.
  • 8.5 The Buyer may opt out of receiving offers and newsletters by email at any time by notifying us by email or by following the instructions in the email containing the offers.

9. Complaints procedure

  • 9.1 The 365JP e-shop shall be liable for the non-conformity or defect of the goods sold to the Buyer, which already existed at the moment of delivery of the goods and which will become apparent within a period of up to two years from the delivery of the goods to the Buyer.
  • 9.2 Complaints concerning non-compliance or defects must be lodged within two months of the discovery of the non-compliance or defect.
  • 9.3 The repair or replacement of defective Goods shall be agreed between 365JP e-shop and the Buyer. The cost of the repair will be covered by the 365JP e-shop.
  • 9.4 365JP e-shop is not liable for any defects in the product caused by the Buyer as a result of improper storage or improper use of the product.
  • 9.5 In the event of non-conformity or defects of the product, please send a complaint to the e-mail address info@365jp.eu, stating the name of the person placing the order, the contact telephone number, the order number and a precise description of the non-conformity or defect.
  • 9.6 All complaints will be investigated and the Buyer will be contacted as soon as possible, but no later than 14 days after receipt of the complaint.
  • 9.7 The Buyer has the right to request 365JP e-shop to reduce the purchase price or to terminate the contract and to claim a refund for the goods if 365JP e-shop is unable to repair or replace the goods, the repair or replacement of the goods fails, 365JP e-shop has not remedied the defect within a reasonable period of time.

10. Buyer’s right to apply to the Consumer Complaints Committee

  • 10.1 If the 365JP e-shop has refused to resolve the Buyer’s complaint or the Buyer does not agree with the solution offered by the 365JP e-shop and considers that his/her rights have been violated or his/her interests have been harmed, the Buyer may lodge a complaint with the Consumer Complaints Commission via the Consumer Protection Board or with the courts. The buyer may lodge a complaint himself or through a representative.
